Flowers and Gifts

We regret to advise that due to seasonal or local availability, we are unable to guarantee that the content of your order for delivery will identically match that which is shown for illustration and guidance on our website or web page(s). In the interests of ensuring that we provide you with the best possible match to your requirements, we may substitute one or more items. If there are any particular flowers and/or colours that you prefer to have included or alternatively excluded, then we will do our utmost to ensure that we meet your requirements. Please e-mail us your special Instructions separately to preference@florist2u.co.uk stating your order number.

If, for any reason a gift item should be out of stock, we will provide a similar product of equal or greater value to avoid disappointment or miss your intended delivery date.


Prices

All prices quoted are inclusive of packaging, postage or delivery, either same day local delivery in Colchester within a 3-mile radius or next day courier delivery within Essex (CM, CO, RM & SS postcodes) or national track and trace special delivery within mainland UK, as per the description (Monday-Friday)*. *Please note: - Delivery on a Saturday costs £2.50 extra, Sunday is unavailable, prices for same day national or International delivery may vary, some items shown may be limited to local delivery only where stated. Value Added Tax (VAT) is not applicable as Just Because...Flowers is not VAT registered.


Our Price Promise

If, within 24 hours after purchasing a bouquet from us, you find exactly the same bouquet elsewhere by an online florist based in the UK for less, we will guarantee to refund the difference. Please note: - This only applies to bouquets available online by a florist based in the UK and must be identical to the bouquet you have purchased from us i.e. colour(s), type(s) and quantity of flowers and must also include any delivery cost for delivery within the UK. If you wish to make a claim, we will require within 24 hours after purchasing a bouquet from us, by e-mail, details of your original order number, the site where you found a cheaper identical bouquet and the bouquet item/code number. We will then review your claim within 48 hours and if valid, we will refund your debit/credit card with the difference between the cost of the bouquet you purchased from us and the cost of the identical bouquet, which you could have purchased elsewhere for less.


Orders/Transactions

We will provide you with clear instruction(s) on how to order and complete the details required on our order form. However, by clicking on the ‘Checkout’ button on the order form, you are therefore consenting to be bound by the following ‘Terms & Conditions’ as well as those appearing elsewhere on our website and furthermore authorises Just Because…Flowers to debit payment(s) for the item(s) ordered.

Payment in full for any such item(s) purchased online using this website is required before your order will be despatched. We accept most major credit and debit cards as stated on our website, however if the card(s) which you are intending to use for payment is not shown, we regret to advise that we are unable to accept payment using such card(s). All ‘Checkout’ pages, which contain personal information is protected using high level encryption technology from a leading online secure payment processing supplier. Please note that Just Because…Flowers reserve(s) the right not to process any order(s) if it is believed that the credit or debit card used for payment transaction may have been made fraudulently and in the event of such circumstance(s) we will endeavour to contact you to obtain any further information.

An e-mail will be generated automatically and sent confirming that your order has been received and is currently being processed, however please check the information received in this e-mail carefully as we will not consider ourselves bound by any form of contract with you until we send you an e-mail confirming your order has been dispatched. We regret to advise that we are unable to accept any order(s) from customers under the age of 18.


Delivery

We will provide you with clear instruction(s) regarding delivery (local Colchester area within a 3-mile radius, within Essex for post codes CM, CO, RM & SS or national within mainland UK), please read these carefully, as well as those appearing elsewhere on our website. Please ensure that the full correct delivery address, including post code is provided for the intended recipient, as well as contact details in the form of a phone number, should we need to make contact in the event of any delivery problems. Just Because…Flowers cannot be held responsible for orders being delayed or undelivered due to incorrect or incomplete information.

In the event that the recipient may not be home to receive the delivery, we will attempt to deliver to a neighbour or post a card through the letterbox to inform them that a delivery has been attempted. Please ensure that the full and correct address and post code is provided for the intended recipient. If an attempt to deliver fails (i.e. in the event that the wrong or incorrect address has been specified on the order), we reserve the right to charge any additional cost(s) to arrange re-delivery or to deduct any shipping cost(s), product wastage, courier or postage return fee from any refund, if the order is subsequently cancelled.

Please be aware that there could be delays in delivery where a third party is involved i.e. in the event of delivery to a hospital, hotel, office or ship. Where delivery has been requested to such locations, the signature of any person authorised to accept the delivery on behalf of the organisation shall therefore be acceptable proof of delivery.

When you have requested next day relay delivery by local florist and they are unable to supply the flowers you have chosen, we will in this event arrange next day track and trace postal delivery instead in order to avoid disappointment or miss your intended delivery date.

All next day flower orders for delivery by post are by Royal Mail Special Delivery by 1pm, which also offers an online Track and Trace facility, see http://www.royalmail.com/portal/rm/track?catId=500185&mediaId=22700601&keyname=track_home. Alternatively, for same day or next day orders by post to Essex, these are arranged by Fastway Couriers, this service also offers a Track and Trace facility, see http://www.fastwaycouriers.co.uk/8HomepageGeneric.html. We will provide you with the appropriate Track and Trace reference number, when we send you an e-mail confirming your order has been dispatched.

In the event of non-delivery of the product(s), our liability shall only be limited to replacement of the product(s) within reasonable time.


Damages/Shortages

Any claim(s) for damage(s) or delivery shortage(s) must be reported to Just Because…Flowers within 48 hours (2 days) of the delivery date.


Complaints

Just Because…Flowers are members of the British Florist Association and abide strictly to the BFA Code of Practice. We are fully committed to providing you with the best possible level of service at all times, however in the unfortunate event that you should have reason to complain, then this will be fully investigated by us and we will endeavour to respond within 5 working days, however at seasonal times, such as Christmas, Valentines Day and Mothers Day, then this may take a little longer. Rest assured, we will keep you informed throughout the complete complaints process and if we are satisfied that your complaint is genuine, then we will be happy to offer either a replacement or refund. Please note: - this does not affect your statutory rights as a customer.


Flowers/Fruit/Chocolates and other perishables

In the unfortunate event that you are unhappy with the above item(s) that you have received from us, please notify us within 36 hours of delivery and retain the item(s) concerned. We regret to advise that any complaints regarding quality are unable to be investigated if made later than 7 days after your order delivery date. All of the above items are naturally perishable and therefore cannot be returned under the terms of distance selling rules and regulations.


Non-perishable items

In the unfortunate event that any non-perishable item(s) are delivered damaged or faulty, we will replace it/them with either an item(s) of the same type or similar value should this no longer be available or a full refund will be offered, provided the damaged or faulty item(s) are returned to us in the original packing within 30 days of purchase. If you are unhappy with your choice, then a full refund will be offered, provided that this is returned undamaged and in the original packing within 30 days of your order delivery date.

Just Because…Flowers does not warrant that any function(s) contained within our website or web page(s) will be error free, uninterrupted or that our website, web page(s) or server(s) are free of any bug(s), trojan(s), virus/viruses or represent(s) accuracy, functionality or reliability of material(s). Unless specifically agreed by us to the contrary, any legal proceedings shall be governed by English law and all parties hereby agree to the exclusive jurisdiction of the English courts. The aforementioned Terms and Conditions do not affect your statutory rights in law.

Just Because…Flowers will in no event be liable for any damage(s) including, without limitation, consequential or indirect damage(s) or any damage(s) whatsoever arising from use or loss of use, data, profits or the like whether in action of contract, negligence or other tortuous action, arising out of use or in connection with the use of our website or web page(s).

We take your security very seriously so we use a powerful 128-bit SSL (Secure Software Layers) Secure Server, when acquiring or processing sensitive data such as your credit/debit card details.
